The constitution and its bill of rights and all it's amendments are Grants of rights given by either the founders and or the amendment process.

Look Obamacare was challenged by the 10th amendment which grants the federal government certain rights over the states which the feds use an excuse to use article 1 of the commerce clause and tax people.

the first amendment and its right to free speech and religion and the press is challenged all the time sometimes such as yelling fire in a crowded theatre these rights are defined and cut back.

these basic rights are granted in the constitution yet get challenged all the time they are the very essence of a grant of rights.

The question really remains why would Texas or any big 12 school want to challenge the grant of rights they signed? the money would have to be so overwhelming that it would be worth it. GOR can be challenged and they are almost daily the question is why would these teams do so?
 
The same reason that MD wanted to leave the ACC. The money in the B12 is nothing compared to the Big 3. IMO the B12 is the most vulnerable because the core really doesn't want to be there. The core of the Big 3 ain't leaving. The core of the ACC will fight to the death to stay together. The core of the B12 has intentions to stay together the next 13 years but would have no issue leaving for the right situation. That is why I see the B12 as being weaker than the ACC. If the B1G came calling to OU they would say yes. If the B1G came calling to UVA they would say no.
