At what point does the university release the report?

Are they holding it back in the same way that ESPN held back the tape? Waiting for the right moment? Or are they legally bound in some way to not publicly release it?

I would think it is privileged information between BS&K and the University. Not sure why the University would ever release it (unless an adverse action were brought against them)...

Seriously, anyone in the know, at what point can we safely assume everything is out of the bag? This slow leak is torture.

My understanding from reading the media is that the University recently gave the SPD a copy of the report. If that's true, then it isn't privilegewd anymore. But if I were to guess, my guess is that the University wouldn't want the report publicly available and therefore won't release it.

Any time the Feds are involved there will be a Loooooooong drawn out (did I say Loooooong?) investigation. They are paid by taxpayers so they can take all the time and money they want.

Cantor said in her statement last night that the report was turned over to the SPD on 11/18/11; since it is apparently now part of the investigation I suspect it won't be released until the investigation is complete - unless statements get made that cause Syracuse University to release it to the media before then.

Agreed that you don't want the report public. Right now, the facts are that SU hired an independent law firm that conducted a four-month investigation and didn't find credible evidence. If you release the report, every amateur lawyer, G-Man, and PI will be taking shots at the document. Also, dollars to donuts it contains private information about innocent people, and if you redact that out you give oxygen to the theme that you're covering something up behind the redactions.

It depends on what result the Feds want, if they want to fry the U and there is no or little supporting evidence, this could go on for literally years not months. But if they want only Bernie, it could be over quickly. If they also want the SPD and DA, again, it could be years or at least months.

It's already been turned over to authorities, pretty sure that would destroy the privilege. But, regardless, if the report was thorough you'd think they could help their cause by turning it over. Maybe there are more unsubstantiated rumors that are discussed in the report the disclosure of which will just serve to fan the flames right now.

I guess. But I would have waited for a subpoena on that...I mean havent all the accusers said (a) no one else knew except Fine and (b) that no one had the tape in 2005? I just struggle to see the good in turning it over and it becoming public.

If things get bleak enough they may do it as a last resort to prove they did everything they could.

Except if you withhold it until a subpoena, you really aren't cooperating fully as was publicly stated on 11/17.

I thought I read that SU gave the report to the DA a week ago.
