In a nutshell, he lamented that PedoSt. wasn't afforded the due process of an NCAA investigation and the infractions committee; Emmert didn't chastise Spanier and the other admins who perpetuated the mess; thought that the penalties were too extreme and he thinks it's wrong to take scholarships away.

I usually agree with what Jay has to say, but in this case, he's dead wrong.

As a lawyer, Jay should know better. A case was presented to the accused. Worst case outcome scenarios were presented. PSU opted out of the "due process" to accept a known, perceived lesser and therefore better, outcome. Alleged criminals forego all kinds of due process guarantees everyday ( grand jury, discovery, evidentiary hearings, trials, appeals, etc.) for a guaranteed outcome.
 
Today was one of the few times most of what Jay said I completely disagreed with.

Jay has had a big axe to grind with the NCAA for quite awhile. So I don't find what he said to be all that surprising. But it doesn't matter, penalties are done now.

Brent Musberger is another one that is on another planet when it comes to this conversation. Going in on the NCAA saying they overstepped their boundaries etc etc etc. His basis is that this was "one" individual who is in jail and will remain their until he dies. Really, Brent...you're not concerned with the cover up, the access to the facilities, the failure to report him to the authorities? All that to save the program, resulting in more kids being molested. Brent Musberger is an out of touch moron.

Ill even Devil's Advocate my feelings on this issue by saying the people who say Penn St "still dont get it" are also out of line. Their job is to protect the school and the program. They realize what was done, the people who did it are gone, they have accepted harsh penalties that they knew were coming. Just because they said "they did whats best for the program" doesnt mean the "still dont get it".

Im definately not as tough on Penn St as some here, but even I can realize that what Brent Musberger said today was an absolute joke.

They are ignoring the idea that the cover up quite likely led to more children being molested. Who knows how many children they could have saved had they done the right thing.

Yeah this isn't hard why can people not grasp this? PSU is NOT being punished for Sandusky. They are being punished for Paterno and the culture of the FB program. Which is why it is silly that some people are bring SU/Fine up.

There has been no due process for Penn State during this post-grand jury time period.

You are correct that Penn State, faced with a four-year death penalty, chose to accept the sentence.

But, for a lawyer the process has felt very uncomfortable.
 
Penn State did not want any process, they want to move on. Due process takes
its due course and takes time.

Why did Penn St agree to the sanctions before exercising their right to due process or till the trials of those Penn St officials indicted were completed ? If Penn State thought that there was evidence coming out exonerating them or lessening their culpability in some way, I doubt they would have agreed to the sanctions, would they? I don't know but it makes me wonder if they feared what could still come out?

I'm not sure I understand the question.

Are you asking whether the NCAA affords due process?

Or, are you asking what kind due process the NCAA ordinarily affords?

Or, are you suggesting that the NCAA never affords due process?

I really am not familiar with how it all works, but my presumption is that targeted schools are allowed to present their side of the story through their compliance personnel.

That was clearly not done in the Penn State situation.

I heard that Penn State was told that the school would face a four-year death penalty if it refused to accept the penalties imposed.

I did not hear that Penn State was concerned that more damaging information would be disclosed.

Ditto. The institution I worked for previously got fined MEGA BUCKS for not adhering to the Cleary Act when reporting sexual assaults. They will be fined a good amount.
