I think the part that your not really considering is the court of public opinion is alot different then the court of law.  The way i look at it is if all this disapears and there is no case there is a high chance that bernie will not be on the sidelines anymore regardless.  The only possible way being aggressive works is if there is enough evidence to put your accusers in prison themselves anything less wont restore your rep. becouse not enough evidence to bring charges doesnt mean you have been found innocent.
Bernies reputation is as high as it could be, he could only go down.  If he had went public 9 years ago then we would be doing all these OTL stuff etc... back then and would likely have to have stepped down back then.  When your life if based around working with kids and your accused of like the worst crime against children there is ZERO benefit from making it public.
Its like a high school teacher who has been accused of rapping high school girls.  You may be innocent but your career is done basically in that field.  Its the scarlet letter of public opinion that they carry for life right or wrong its there.
