Exactly what I've been saying.

And I still think the fact that Davis didn't ask Laurie Fine flat-out why she didn't stop her husband from abusing a 15 year old makes the tape open to skepticism.

Hopefully this will never get to court of any kind. It is being played out by the media and the public though which is where SU and the program can be hurt. Wonder if he did call Bernie but was unable to get a good response.

Taken circumstantially, the tape is incredibly damaging. But it doesn't establish dates / timeframes of abuse, and a lot of it is speculative heresy on Laurie's part.

every phrase was so vague. "I don't know why he did that to you" "He has issues" "I got the worst of it"

what happens sometimes is even when 1 thing isn't admissible in a court, it can lead to something else. just like davis accusations may be past sol, they have and may still lead down other avenues.

Actually Rossi did say if there is a case of some sort and LF is called to testify on her husband's behalf, the prosecutor can use the tape as evidence.

Tomaselli is the real danger for Fine. That can still be prosecuted I think but don't see how that could damage SU.

Listening to the tape, I didn't hear conversation validating Davis's assertion the Laurie saw him being abused through the basement window, or did I just miss it. The tape sounds like Laurie is just agreeing with Davis's accusations and is trying to placate him, maybe because she wants him and wants to be on his side?

This is what I meant when we were disagreeing on that point earlier.

There is no question that the tape paints Bernie as a gay man--one who appears to have sociopathic tendencies. It also paints his wife as an absolute loon.

But it doesn't establish evidence that Bernie is a pedophile. Even the most damaging stuff ["boys" , "you were a kid"] are vague references.

Davis never purported to make this for the benefit of "court." That said, i think he did a pretty fantastic job of asking leading questions and commenting on the responses, in order to get across what he wanted. The transcript, in its entirety, is not vague. If he had asked more specific, pointed questions, it would have raised the suspicion of a recording.

He didn't call Bernie because he had spoken to him many times before and know Bernie didn't discuss this stuff. That, or he DID try to get Bernie on tape and was unsuccessful. It's much more difficult to get a criminal to discuss his crimes than to get someone else to comment on them. Because of television/movies, people think wiretaps tend to result in complete and unassailable confessions. They don't. They're usually just pieces of a case, and/or they lead to other things.

What a household. Laurie is a pretty deplorable person. She's cooking meals for players, and hiding this secret at the same time? All while enabling Bernie? More 'criminal' than anything the Penn State administrators have done.

AZ, I was talking to Emil a few weeks ago about the Penn State case. I made the comment to him that if this was taking place at SU, he'd probably be involved and CNN would be outside our office building. Two days later, the Bernie case broke.
