The issue is that the tape on its own is flimsy without other sources , so they didn't run it. Without another confirmation a reasonable person could also conclude, as Whitlock notes, this is a relationship gone bad. This tape incriminates both Fines, not just Bernie. They (ESPN and PS) couldn't really move forward with it unless someone else came forward. This may also explain why the PS spent so much time interviewing Davis back in 2002, but eventually came away with nothing. Without Lang confirming the story, all they had was a he said, she said ugly sex relationship without a crime. Worse, if credible, the she said (Ms. Fine) would never go on record because she would incriminate herself for witnessing child abuse in her home and not reporting it. Hence, from a media perspective, you could see where a reasonable person in 2002 says to Davis, well, you had sex with Ms. Fine and you are alleging abuse by Mr. Fine, so this seems suspicious. Please give us another source and when the sources came up with nothing, the story goes away for several years until someone else comes forward.

The real legal problem isn't so much the tape for Fine- it is the second and really the third accuser.
