He played in JUCO and is saying that shouldn't count. Not really comparable with Kyle's situation.
Good point. Just coming to post this. He played 2 years at New Mexico Military Institute (JUCO), 2 years at UNM, and one year at Vandy.
 
Means we will still find a way to get screwed and swear at the NCAA for it.
I am not a lawyer, so maybe a lawyer can read the memo attached to this ruling and interpret it. I think the big thing that may come out of this is that the eligibility rules within the NCAA bylaws are now subject to the Sherman Act (anti-competive agreements) due to the new NIL landscape.

As others have mentioned this is different than Kyle’s case, but I’m sure a lawyer could make some argument on why denying Kyle (or anyone) a 5th year is anti-competitive in nature and goes against the Sherman Act.

I don't believe the differences are relevant to the conclusion. You have guys getting 6 years or 8 years of eligibility, and Kyle would be shut out for a few minutes of garbage time of one extra game?

That's how I would frame it.

2) Dart gets another year of eligibility somehow and transfers to be our backup. Because, D.A.R.T.
3) We win the whole damn thing.
4) NCAA retroactively declares McCord ineligible and revokes our Championship.
5) Autry gets a 5 year extension.

It’s the reverse-Fabricio Melo rule.
 
If I understand correctly, Day sent in on the waiver, saying he shouldn't have played Kyle. With NIL, this would seem a simple case of irreparable harm. They didn't know then...

Kyle's damages could easily be quantified, BUT who pays them? OSU, NCAA? Well. NOONE cuz, they say screw it and give him the extra year. MAKE IT SO!
 
So if you were coach, how would you explain to your number 2 that despite him working his way up the depth chart, you were going to play the guy he beat out? Would you tell him it’s because you have a crystal ball and saw him years and another team later setting records, and he may need to stay on the bench due to the potential?

The NCAA didn’t rubber stamp this, Pavia sued the NCAA and received a court ordered injunction. If Kyle loses his appeal, will he sue or will he leave? Should I Sue or Should I Go Now? ;)
