When I did criminal defense work, I had a case which, at first blush, seems like this case. My client had relations with a young woman. The next day, she charges him with rape. He loses his job when the charges are reported. Facts:

She can over to his house, at about 11:00 PM, to "watch a movie."
(Unknown to my client, she had allegedly taken a benydryl before arriving, because my client had cats.)
She climbed into his bed, where he put a DVD on the television.
A while later, they started kissing. One thing led to another. My client said she was very responsive when this started.
At some point in time, he detemines that she has fallen asleep. (Remember the Benydryl)
He stops IMMDEIATELY.

She wakes up, goes home late (to mom and dad, very strict parents). and claims rape.

He is the only client I ever recommended testify before the Grand Jury.
The Grand Jury "no-billed" the case and it went no further.

Sometimes, both sides are right.
 
very important not to jump to conclusions about things so serious but i caution telling some people on this board that as they'll crucify you.
