The judge pointed out the Wells Report is based on the charge the Patriots/Brady was generally aware the balls were being deflated. No evidence has been shown their was cheating in the AFC title game.

The phone is just something the NFL used to score points in court of public appeal. Brady's texts to McNalley and Jagzerertski were already in possession by the NFL. Brady offered the names of everyone he texted. Wells admits he never told Brady he would be punished for not handing over the phone. Also, when this case was filed a bunch of Brady's private emails were published. Those emails showed why Brady didn't want to hand over his phone. We learned about Brady's anger at not having a white pool cover, what Brady thinks the shelf life of Manning's career is, and what Brady and Bridget Monyahan do to parent their child.

This whole thing is a witch hunt. The NFL wants to move the goal posts in what they have to do punish a player. If they could prove these charges they would have nailed the Pats. Instead, the have played the court of public opinion really well to get Brady worse than the actual facts of the case.
