Carrier maybe would argue that by just only changing the roof and locker rooms that the changes are not “material enough “ to constitute a change of the dome to something completely different. For example if you paint your house, refurb your bathroom and build a new roof, is the house completely changed? As it correlates to the Dome, Carrier would say no your house (Dome) didn’t change enough,it’s still a 5 bedroom, 3 bath house.(Dome is same foundation, capacity and structure). I know it may not be a great example but it is intended for illustration. I don’t know if there is a magic number (percentage) or not from a courts standpoint. Another data point. For Made in America, the Federal rules of Procurement require 50% of the parts to be made in America. Someone with FAR/DFAR keep me honest there.
