The issue is that the tape on its own is flimsy without other sources , so they didn't run it. Without another confirmation a reasonable person could also conclude, as Whitlock notes, this is a relationship gone bad. This tape incriminates both Fines, not just Bernie. They (ESPN and PS) couldn't really move forward with it unless someone else came forward. This may also explain why the PS spent so much time interviewing Davis back in 2002, but eventually came away with nothing. Without Lang confirming the story, all they had was a he said, she said ugly sex relationship without a crime. Worse, if credible, the she said (Ms. Fine) would never go on record because she would incriminate herself for witnessing child abuse in her home and not reporting it. Hence, from a media perspective, you could see where a reasonable person in 2002 says to Davis, well, you had sex with Ms. Fine and you are alleging abuse by Mr. Fine, so this seems suspicious. Please give us another source and when the sources came up with nothing, the story goes away for several years until someone else comes forward.

The real legal problem isn't so much the tape for Fine- it is the second and really the third accuser.

Yep total BS. Also how about asking her? If she really felt as bad as she did in the conversation, wouldn't she say yes it was her? Why would she deny it? Wouldn't she have finally agreed to assist?

Later in the call, Fine tells Davis that she wanted to come to his defense but she just wasn't capable of it.

"Because I care about you, and I didn't want to see you being treated that way ... ," Fine said.

Also ESPN said that they didn't run it in 2003 because there was no one else to corroborate the story. Well isn't the tape corroboration? Thank God this didn't come out then or it could have been a distraction to our championship (unless it was late 2003). And they didn't even try and confirm it was Laurie until 2011. What ESPN?

After a second man said this month that he was also molested by Fine (that man is Mike Lang, Davis' step brother), ESPN hired a voice-recognition expert who said the voice on the tape matches the voice of Laurie Fine.

You may have been joking but your scenario is the only thing that would make sense in regards to this case. There are a ton of holes in this story the way Davis is claiming. However under your story this all makes sense.

Another interesting thing is that both Laurie and Davis referred to Bernie as "the King of Syracuse." Laurie did it in the Syracuse morning TV show, and she came across as somewhat sarcastic, I thought. That sarcasm could be anger rather than amused annoyance, the latter being what people might take it for if they assumed the Fines had a loving relationship. It can't be a coincidence that both referred to Bernie in that way, and implies some kind of connection/relationship. IMO. Could be very wrong.
