Formal notice is immaterial as Maryland has provided constructive notice via announcing they are joining the B1G and the CIC. The Maryland Court already ruled on this in a past hearing.

That is key. SU as a private school is not getting state dollars to cover overruns in the athletic department. In fact they reported $3M in "profit" in the latest reporting cycle.
This last cycle Rutgers needed $27M from the state, student fees and other transfers to cover it's expenses.
