My buddy’s cousin in law owns a carrier pigeon company and he said that someone from the NCAA is using one to send something from Indianapolis to Syracuse.

The cousin in law swore he gave them his best pigeon and it should make it to Syracuse by the new year, pending wind and weather conditions.

Interpret this as you will but I think it’s a good sign.
 
Just throwing out random ideas here, but what if Kyle specifically asked before the 5th game at Ohio state not to play because he didn't want to burn his redshift. Day put him in anyway and told Kyle he'd be off the team if he didn't go in. Maybe then Day signed off on this story as the appeal to the NCAA.

The only thing we know for sure is if there’s not some twist we don’t know about, then he will be denied the wavier

Now, the one year anniversary of Kyle’s commitment is tomorrow, Dec 17th. There has been much talk that the school was hoping for an answer on the appeal sometime this week. Let me ask this, why is the “CLUB DART” NIL party being held during the middle of the week? Where better to make such an announcement?
As we seen today with Brady Norton, schools try to land commitments while the kids are in visit during portal season. It prevents them from going on to the next opportunity. Rickie Collins was a sho in to accept on his visit but the staff didn’t offer.

Kyle will get his extra year, and a public announcement will be made Wednesday Night. I could certainly bring completely wrong, or slightly wrong- but I firmly believe that my theory holds strong possibility!

Just want to confirm, the success of Kyle's appeal hinges not only on the NCAA ignoring the plain language of the governing statutes/regulations, but also ignoring years of precedent interpreting the statutes/regulations?
In theory yes but there is also a long history of the NCAA granting (what feels like) every request from big time programs.
SU has never benefited but with our return to prominence, McCords high profile and the desire to protect OSU brand I would think the NCAA would cave to the request

It isn’t about a lawsuit helping SU. It’s about McCord having a case to sue on his own behalf since he will be losing out financially as a result of a decision made by a member institution employee to which he was a subordinate.

Player is subordinate to Coach, Coach is subordinate to NCAA, it’s not leaping to conclusions here.
A lawsuit for financial damages does nothing for eligibility.

NIL was around during his FR year.

He cannot bring a lawsuit for denial of eligibility until he is actually denied eligibility which seems to have not happened yet. Then he needs to decide if it is worth it. He may not.

If he does he has to hire lawyers out of his own pocket seeking one of two resolutions…

He can say that he was the #1 passer and the going rate is $3M

1. A settlement where the NCAA pays his legal fees and grants him another year. This needs to be settled before the draft deadline. If it does not then he will declare for the draft and not settle.

2. He goes all in for the $3M and declares for the draft.

Both are good outcomes for Kyle. The only good outcome for SU is #1 within the next 3-4 weeks. Which is a very small window.

I still think to avoid any messes that the NCAA does 5 for 5 which they are already looking to do. That might explain the delay.

Forget the damages argument.

You have a star player who is looking to return instead of one wants to leave early. It’s good for the sport if they can find a way for him to stay. He isn’t looking for year 6, he just wants a 5th year, which but for a quarter of play as a back up in a blowout, he’d be entitled to.

The NCAA has had the appeal for months. If it was such an open and shut case , you think they would have made a decision by now? Amiright?
They may want to wait to see if McCord wants to use it. “Courts” don’t like to decide cases they don’t have to decide.
 
I would obviously love to have McCord for another year but what exactly would these hypothetical damages be awarded for?
There wouldn’t be. However, making an exception for Kyle could open litigation floodgates.

I really do think that they are waiting on the 5 to play 5. They need to make that decision within the next few weeks though to be fair to the SRs who are NFL tweeners. And they need to make it well before Spring ball to allow these kids to practice with the team.
