The tape bombshell no doubt throws in more beyond-bizarre twists and looks very bad for the Fine family. But one huge question is if the tape was recorded in 2002, what was its role, if any, in the various 2003-2005 investigations? Did Davis present or try to present it to ESPN, the Post-Standard, SU and/or the SPD? And if so, why did all of them apparently see no credibility in it then? Or if Davis did not share it then, why not?

Posters are asking that same question in every thread. Not sure anyone has any idea the answer to that, or at least they aren't saying anything!

All I can think of is maybe he didn't reveal it then to protect Laurie Fine, for some reason? For emotional reasons?

I cannot imagine ESPN or the PS not being all over this tape had they known about it. I mean, he made the recording during the time period when the PS was investigating his allegations.

It seems as if (but who knows?) that the tape was not provided in 2002. I could see why maybe it wasn't turned over to SPD since Davis got the SOL brush off. But why not to the PS, ESPN or BSK? Was it not even given - initially - to ESPN in 2011? Why do you even need an accuser #2 if you have the tape? These are logical questions to ask. Will the PS or ESPN ask them?

Assuming the legitimacy of the tape, I hope the accuser(s) will (a) get some sort of closure and (b) some financial payout and (c) professional help.

...did the $5,000 have something to do with this...money for tape...otherwise, I cannot see a reason that Davis did not use tape long, long, ago. This is simply bizzare and would have made the accuser credible instead of all the BS that has been discussed...including JB's defense of Bernie...how does someone hide these kind of facts...OUCH

The $5000 came before the tape, it's actually mentioned in the conversation.

ESPN seems to be saying that they had to verify the tape's authenticity before unveiling this.

didn't I just read that Mrs Fine had sex with Davis? and in the article a point was made he was 18 at the time?

This tape leads me to 2 conclusions. 1) fire Bernie asap. 2) this story is even more bizarre with even more questions than before, if thats even possible

I said that in another thread. It sounded like she was a trusted friend to him. The tape was after SPD but before everything else. Maybe he was hopeful his claims could be proven without bringing her down also.

The tape now being reported is 40 mins long...yikes

You could tell it was snippets. BTW, where did you see/hear it was 40 mins?

1. I have lost all faith in humanity at this point. I really have.

2. The tape (at least the snippets I heard) are very odd. Almost as if the tape were being made solely for these purposes today. In NY does Fine have to know she is being taped?

ESPN reported they had the tape in 2003. So why didn't they report this along with Davis' initial recent accusations? If they had to "verify" the recording, they've had 8 years to do so.

That is strange. Unless Davis refused to let them use it for reasons theorized by others (protect Laurie).

They said he was in Utah when it was made and she was in NY. Neither states require the person to divulge to the other person that they are being states (some states require that). So it is all legal and admissible.

I do not understand this at all. ESPN had a tape of Fine's wife corroborating Davis's account and they decided to wait until they had Mike Lang? Really?

According to Davis he NEVER went to the SPD with the tape. Sorry but I find that extremely odd. He says he created the tape because the SPD did not believe him. Once he got the tape why did he not walk into the SPD and play it for a detective?

In addition how did Davis create the tape? It didn't sound like he was on speaker phone. He is a pretty technical dude.

I'm with you.

This whole thing seemed unsavory from the beginning, but at least there was the prospect of it not being true. That's still true today, I suppose, but with more an more info surfacing, this looks like it is going to snowball. And if it's true, I wonder how many other victims might be out there?

Oddly, the tape seems to address that. Along with a whole host of other issues. Which is why the tape seems odd to me.

Living in the basement of a quasi-foster home where the husband molests you and the wife has Desperate-Housewife-sex with you ... and you don't decide to leave the situation until you are 27.

Tabloids couldn't script this stuff. It's so unbelievable that it's believable? I mean, this is out there.

I feel as bad for the Fine children right now as I do for Davis (if he isn't lying about anything). That would be one of the most traumatizing things to have as a kid. While you can say Davis was an innocent victim, he clearly kept it going way past the age when he stopped being innocent ... the Fine children are innocent victims here too. I hope to god they weren't subjected to anything resembling this crap.

Admissible? Into what? A trial against Bernie?

At least one of the kids was pretty messed up, right?
