Aaron Hernandez had advanced stages of CTE

I think the moment that colleges weigh the costs of future lawsuits against the value of publicity via BCS membership and costs come out on top for them, that's the moment that football dies. That might happen way before the NFL would be prepared to call it quits but setting up a feeder league to make up for high-level college ball in an uncertain environment probably doesn't fly and essentially means the unsustainability of the NFL.

Jose Baez, Hernandez’s lawyer, said Hernandez’s brain showed a level of damage that was seen in players with a median age of 67 years.

Baez said he had filed a lawsuit in federal court against the Patriots and the N.F.L. on behalf of Hernandez’s daughter, Avielle. The suit seeks unspecified damages for loss of parental support. The suit alleges that the Patriots and the league were “fully aware of the damage that could be inflicted from repetitive impact injuries and failed to disclose, treat or protect him from the dangers of such damage.”

Baez said he did not rule out adding the N.C.A.A. or the University of Florida, where Hernandez played college football, to the complaint.

As long as football doesn't hide the consequences and dangers of possible injuries assumption of the risk will be a defense to any lawsuit.

The NFL lost the concussion lawsuit by settling because they deceived the former of the risks. Nowadays the players are aware and are informed.

Plus Hernandez's ambulance chasing dirtbag attorney won't be able to prove when Hernandez acquired CTE playing football. This lawsuit will not go anywhere Hernandezs finance is struggling financially as her family has disowned her for her betraying her sister who had her BF killed by Hernandez and she supported him in the trial over her sister.

She wants a payday which she won't get. I really wish for lawsuits like this we followed the British model of the loser of the lawsuits having to pay the legal costs of the other party as it would deter awful lawsuits. Baez is pure scum and Jenkins deserves nothing.

I agree with you 100%.

He played football from the time he was 6 years old until college, so about 16 years or so but is suing the Patriots when he only played in the NFL less than 3 years...so they must be at fault because they have the most money.

Amazing

sorry, i'm not buying it. his troubles started when he was a kid

Agree, if they're going to go to the root of the pattern, they're going to have to add his Pop Warner to the lawsuit.

My larger point was that these kinds of lawsuits at the college and NFL level will become more common in the future. Hernandez is one of potentially thousands of cases with more or less merit. SU is already dealing with one. The NFL may be able to weather the storm but colleges will be less prepared to hold their ground since big time athletics really isn't part of their core mission. Let's be honest here. If the pressure of lawsuits forces colleges to rethink football as an offering, it may well sink the NFL too.

Modern athletes will have no standing as long as the risks of the sport are made aware.

Players can sue but they won't win in court as assumption of risk is a huge defense and a lot of states have contributory negligence statues that
Bar recovery and playing football contributes so the suits would go nowhere.

Biaz the attorney for Hernandez is pond scum and is trying to extort money.

Also because Hernandez didn't opt out of the concussion settlement this lawsuit will get tossed once it's before an actual judge.
