Right, but ESPN did have the tape. So did the Post-Standard. Seems like those outfits have some explaining to do.

Taking Schwarz as gospel on this one, that is really good news. If SU had known about the tape and allowed fine to continue, the Board of Trustees, Cantor, Gross, BS&K et al would have all had a some major explaining to do. Parents here would be able to complain about a lot more than the $53k a year they pay going to Marrone's salary.
