It was before the investigation, Schwarz stated ESPN did nothing with tape because they could not corroborate Davis's story. He said Davis did not present the tape in 05 because he did not know what to do with it, which to me would mean he did not know if it was legal to record.

others have pointed out that perhaps he was somewhat friendly with Fines wife and didn't want to take her down to at the time or as said here he maybe didn't think it was legal. Or worse yet God forbid it has something to do with what OrangePa posted. The latter is highly doubtful as that report has to be out there all over the place.
