Guilty or Innocent, Bernie is going to be one seriously colossal distraction if he were to return. So my question to all of you is simple:

Taking guilt or innocence out of the equation, do you want Bernie back? My answer is no.

why would he be a distraction if he were innocent?

This all probably takes time to play out and if he ends up being innocent, I don't see how or why he'd be a major long-term distraction.
 
If he's innocent, yes. Shouldn't punish someone if they're innocent.

Based on the way JB has stood behind him, this isn't even a conversation if Bernie is innocent.

Secondly, if Bernie is innocent, but it was decided it would be best if he didn't come back, that would be a travesty. You would give legitimacy to false allegations.

First, you can't take guilt or innocence out of it because that is a major consideration to the answer. If he is innocent and not found guilty of any criminal charges and if it is shown that he didn't just get away with something because the SOL ran out, then yes I want him back because he deserves to be back if that is true.
 
To be honest, I keep hoping this will die down a little and the investigation will play itself out. Right now there seems to be something new everyday, some of it speculation and some of it real - DA/SPD p*ssing match, search warrant, new stories in the local papers, etc. It's already a distraction and I think it is starting to wear on the team.
 
Short of D & L retracting accustions, there will be a cloud over Bernie regardless of how this plays out.

Most likely scenerio, not enough evidence to go further, but not enough to 100% absolve Bernie.

Under those circumstances I think you need to not allow Bernie to come back as we would never know for certain if another shoe might drop. If Bernie were allowed back & then that shoes dropped I think it would be extremely damaging to the university and the program. Send Bernie to a golden pasture & not take that risk.
 
I think this thing only ends one of two ways, with not much room for a middle ground.

A) Bernie is found to have taken part in something illegal. Maybe SOL doesn't allow prosecution, but the word will get out. If I am not mistaken, SOL only comes into play if the defense asks for dismissal on those grounds. Which means he could be charged with some. It isn't up to the police or even prosecutor to determine SOL. Kind of like an insanity defense.

B) it is found that the accusers conspired in some way to blackmail/extort money from Bernie Fine or the University even. It could be something else, but it would be clear that Bernie did nothing wrong.

Nobody can afford to have no answer when all is said and done.
 
If he's completely innocent then yes, but I don't see him coaching another game either way.

I also believe it is wearing on the team. Ultimate "me too" post right there. Absolutely nothing of value!

If a member of your family is found innocent of charges would you let them come to Thanksgiving dinner? or do you exile them as punishment for being singled out by a meth addict and a drunk?

Apparently you've never heard of the Duke Lacrosse Case?

Assuming someone is guilty just because an accusation is made is just plain wrong. You have no knowledge as to the mental state or motivations of the accuser. Luckily we have a system of justice in this country. I could understand if there was at least a grand jury finding but jeez, the guy hasn't even been charged yet with anything.

How would you feel if you lost your job and/or career because someone accused you of doing something you didn't do?
 
The only way Bernie should be allowed to coach is if he is 100% absolved of any wrongdoings.

If Bernie cannot be charged due to statute of limitations...and Tweetle Dee and Tweetle Dumb never retract their statements, that would change nothing. It'd remain a case of he-said, "she" said...

Even in this situation, there is no way Bernie should be allowed to return.

The problem is that it is VERY unlikely that he is ever going to be proven innocent. Much more likely it will be a case of guilty or not enough evidence to assume guilt or a conviction. Not guilty does NOT mean the man is innocent. Walk down memory lane... remember the OJ Simpson trial? He was never found innocent. He was simply found not guilty.

I say all of this because the problem and real shame in all of this is that if Bernie is truly innocent and did not commit these alleged crimes, a man's reputation and life as he knew it is gone forever. No one will ever forget these accusations and the possibility of him being a child molester; this will follow him forever... again, that is the true shame if the man is really innocent. However, we will unlikely ever know.

In response to the original question... I say YES. I would hate to see him be tossed to the side if these allegations are not proven. Also, it's not like he's going to be on the sidelines that much longer. I would prefer Boeheim and Fine to leave together as it should be (of course, as long as he is not found guilty).
 
Can't say for sure whether bernie is guilty or innocent, but recent history Dominique Strauss-Kahn managing director of IMF was leading candidate to run for President in France next year. He lets a maid into his hotel room in New York and is accused of rape. DA wouldn't prosecute because of maid's background, he lost both his job and ability to run for president. Even if Bernie is innocent many in the public will still consider him guilty, and it would be best for the perception of the program for Bernie to be gone.

Because this *isn't* going to be resolved that quickly, and all the TV people will talk about is "alleged child molester Bernie Fine".
