I’ve said it all along and will keep saying it - this will come down to the NCAA’s feeling as to the likelihood of a lawsuit if they don’t grant the waiver. And they are burnt out on lawsuits.

When projected financial loss is involved, it changes things.

Syracuse isn’t the lawsuit type.
 
Well as nice as 50/50 sounds, it’s still 50% he gets denied. I’m not getting my hopes up until it’s final and the news is good.

I don't put much stock in the percentages -- because honestly, who knows.

But that just means that the University [or the AD department] feel like they have a puncher's chance. Which is better than zero shot.

And also, it just goes to show the degrees of freedom around this sort of thing, given the NCAAs inconsistency, the impact of legal actions, etc.

I think you are approaching this like a lawyer would, parsing the language for an advantage.

I'm trying to figure out what would be advantageous for players to keep them from being scum bagged out of eligibility by coaches overall but also, selfishly, what possible grounds could result in another year of McCord as Cuse QB
 
Well we damn well better learn to be, because that is why we get screwed by the NCAA all the time. Play hard ball with them and they fold like cowards.

they should’ve sued over the disproportionate penalties to JB and the probation. None of which fit the crime. They didn’t. Basketball is still paying for it.

McCord will end up having to bring any suit, I doubt he will.
 
Kyle is 22. His first 2 years of college he threw 58 passes. I watched a UNC team last year for hoops with 25 and 26 year olds.

It’s not like it’s bad for business either for the NCAA. A big name QB that can sling it 500 yards a game is good for advertising and ratings.
 
This is 100% correct. Also, with the 5 in 5 projected to go into effect next year that also adds another level to Kyle's situation.

Do I think he would have won the appeal if it was two or three seasons ago, Absolutely not. However since there are ground for lawsuit now, which the NCAA wants to avoid at all costs, it's a completely different story.

If they are smart (McCord, Fran, Wildhack - and I think they are..,) the waiver request would have come on letterhead and messaging like:
Shipman, Hennessey, & Gold, LLP

We are contacting you on behalf of our client and NCAA student-athlete, Kyle McCord, with the Syracuse University men's Football Program...​
(and signed off by a lawyer)​

I will go back to the timing issue. Pavia can wait until July to get a ruling and still play in 2025. McCord needs one soon otherwise he will go the NFL route.

Also if the courts rule student = eligible, then Kyle could play in 2026 too.
 
The one parallel to the JUCO thing is that the ruling could be broad enough to question the NCAA's authority to make somewhat arbitrary rules about eligibility. Prep school doesn't count, JUCO playing a prep school counts. 4 games don't count, 5 games do, unless the fifth game and beyond are conference championship/bowl/playoff games. Then it's ok again.

The court could toss a bunch of that out and say the NCAA doesn't have that authority. Don't know how likely this is, but it would be catastrophic for the NCAA. It's an existential risk if they let this stuff play out.

A court ruling that they can't do anything other than enforce academic eligibility based on enrollment and grades renders them feckless and hastens their demise. If they can get Pavia to drop the case, grant him his eligibility and Kyle his and do the same for others, then say we're going 5 for 5 in the near future... They can head a lot of it off at the pass, and preserve the power they can hold onto for longer.

What is the risk of no limits? The biggest IMO would be to the powerhouse programs. The NFL talent will be 18-22 year olds. While the college lifers will be 23-27 for example. It can even the playing field.

Almost like how Kentucky BBall had the most talent but the kids were 18-19 and didn’t win anything. While San Diego State with 22-23 year olds made a Ginal Four.

I think its somewhat telling that at the DART Party last night, both Pena and Gadsden had their futures talked about by Fran. McCord...nothing. If he was for sure going to the draft, Fran would have talked about it and wished him well

They don’t have the decision yet.
