To the extent it means to propose a sort of judicially ordained immunity from the terms of the Sherman Act for its restraints of trade—that we should overlook its restrictions because they happen to fall at the intersection of higher education, sports, and money—we cannot agree. This Court has regularly refused materially identical requests from litigants seeking special dispensation from the Sherman Act on the ground that their restraints of trade serve uniquely important social objectives beyond enhancing competition."

"But this case," Kavanaugh stresses, "involves only a narrow subset of the NCAA's compensation rules." He says he is writing to "underscore that the NCAA's remaining compensation rules also raise serious questions under the antitrust laws." (This is from SCOTUS Blog site chat.) It's being interpreted there as: "Justice Kavanaugh's concurrence pretty much begs for a case challenging the remaining NCAA rules (compensation)."

Yeah, this as a ruling in and of itself isn't Earth-shattering, but it's a huge warning to the NCAA that they can't continue as is.

If the NCAA had any doubt about how this would shake out, one would hope a unanimous decision would help to remove it. I am dubious that will be the case.

Reading the decision I am not sure the court is willing to expand for non education economic compensation except maybe kavenaugh.
I expect the court to strike down the state laws on likeness compensation unless Congress acts. If Congress acts then those will be the new rules.

The NCAA model effectively has to be mostly blown up with the way this is trending. I presume the monumental task this would be has more to do with the NCAA fighting this than anything. Where does the money come from and how does it not turn into a much smaller list of schools participating in the top level of collegiate sports, whatever the future format looks like. The short of it is it is a giant mess to try and figure out.

Without a doubt. Paying players for play is going to knock out a lot of collegiate institutions from being able to compete. But this is the way it's trending because it's what America wants. We'll see if fans across the country still like it after athletes start cashing in

It will be interesting to see how these academic perks align with state laws that forbid state financial aid and tax monies going toward athletics. Not every state has them, but quite a number do.
