Winston case has escalated

If there is physical evidence of rape then he hopefully goes to jail and there seems to be a bit of the TPD pushing this aside, which is creepy as hell. It's freaking football and it just amazes me how confused some peoples priorities are, especially a person that is suppose to protect their citizens.

I'm having a bit of trouble with the statement from her lawyer regarding what the police officer told the lawyer (and why did she have a lawyer in the first place at that point?). Nothing that I've heard is untruthful - her name will get dragged through the mud, Tallahassee is a "big football town" and her life could be miserable if she pursued the case. If those statements were offered as advice (knowing that if they got into the middle of this prosecution and she bails because of the heat of the case it would be worse for all), I don't think the officer is out of line as much as those saying he should lose his job. If they were a warning with the intent of deterring the prosecution, then he's in trouble and should start looking for a nice security job.
 
Not really. There's always chance this was mutual act. Curious what the rest of the rape kit shows for evidence.




Seems unlikely if he was unwilling to testify. If it was consensual, I don't know why you wouldn't just say so.

Yep- if it comes out to be true, that police officers career is over. That's a problem with small town police officers. (Disclaimer: I have no idea to how big Tallahassee is, so calling it a small town could have no merit)

believe it or not, and i could be wrong, but i think there are stats out there that say it's better to evoke your right of silence then to go blabbering. remember, he doesn't have the burden of proof. the state does.

I understand that. What I'm saying is that if it was truly consensual - i.e. there is DNA evidence, so it appears pretty clear that they had sex - you do not stand to gain by not testifying. It certainly doesn't help him that teammates told police that he wasn't there. An alibi is worthless if DNA places you there at the scene, committing the act. You need to explain, or her version of the story goes unopposed.

How do we determine his intent? I think he is toast - Texas toast.
 
One thing that really bugs me is the "JM hasn't said anything" crap. Clemons, ARod and many others screamed from the rooftops and they were wrong. I don't understand the "They have to please me" feeling people have to prejudge someone. "I don't know, he sure seems quiet to me" and now it leads to him being guilty.

Shut the fluck up until you have to talk.
 
Oh man Schwarz is on the case. I just had a visceral reaction watching him gleefully read the prosecution lawyers statement to him. "If she wanted to destroy him, she would've done it already". ??? Well, she's doing it now and why now?

Take this for what its worth, but I talked with a friend who is a graduate of FSU and he told me that some of the fanbase thinks this case opened up now because a fan of Ohio State was tipped off to file an open records request about this alleged matter and that something shady happened in Tallahassee and they wanted to rattle Florida State in hopes that voters would put Ohio State in the NC game. I told him its crazy to think that has happened, but with Urban Meyer and Ohio State fans being a little pissed off that they are clearly on the outside looking in who knows. All I can say is that this case appears to be more serious than I originally thought it was and if I was FSU I would be a lot more concerned that Winston may get charged than I was before. If Winston gets charged with a felony then he would automatically be suspended from the football team and the NC race would get affected immensely because without Winston and the backup QB having his knee scoped FSU would get housed by Alabama in a NC game and the voters may put Baylor or Ohio State in their if Winston got suspended before the BCS title game selection.

I don't think that sounds crazy at all. I honestly 100% think something of that nature is how this transpired.

there are plenty of examples of this being a legit exercise.

The real winner is the girls lawyer who somehow conjured all public opinion against innocence and the TPD with some swift wording and possible manipulating.

Now if it comes out this detective did a very bad job with this case,does this open the doors on appeals to closed cases where he was the investigator and got a conviction.

I don't think she has anything to do with how this case is proceeding now. For whatever reason it leaked and now it has its own legs.

I was trying not to single you out and I did you read that you said it was a serious problem.

I just went back at the earlier statements of his lawyer and it looks like he is winging it as info comes.Why didn't he state from the very beginning that it was consensual s e x and the DNA was going to be JW'S in his earliest press releases.

I am beginning to think JW'S lawyer is the leaker of evidence that will eventually come out anyways.Always does. The state has nothing to gain at this point of a new investigation by releasing any info before making a decision, but it appears his lawyers does.

After every leak of info his lawyers comes blasting the information trying to win public opinion over the national scene as I am sure he is winning no matter what in the hometown.

And why in the world did the police redact the whole police report,when all they had to do was black out the victim's name.At that point from what I have gathered winston was not the known suspect. OR MAYBE HE WAS
The "acting" police chief said some things in the report was not factual in what was released as being factual...could it be when the TPD said she was drunk,when toxicology results said she was not.The height of the criminal might have changed like some were whispering from 5'9" -5"11" to maybe being over 6'.

From what I also understand is that the address was listed in the original report,but redacted...why?

The longer this goes the worst it is looking for JW.
 
the girl's lawyer is correct in saying this...would would a DNA leak hurt JW'S case if it was consensual. why didn't his lawyer from day 1 say it was consensual?

Yeah, it's all very strange. It seems like one of those Law & Orders where the client keeps lying to his lawyer, and the hole just gets deeper and deeper.

I was out of town that night! Lawyer then finds out he wasn't.
I never met that girl! Lawyer then finds out he did.
She's an Ohio State fan! Lawyer then finds out she ain't.
Etc....
 
And now his roommates refuse to testify against him. They were in the room at the time of the alleged incident.
 
Not to worry. If the evidence becomes overwhelming against Jameis then Jimbo has promised to bench him for the first series of the national semifinal. Because at FSU "they do things the right way".
