Winston investigated for sexual assault

Doesn't matter, he will play on Saturday and won't be distracted by this b/c he has been aware of it for almost a year. Gotta look for other game day advantages.

Normally I'd say innocent until proven guilty.

But I feel strongly that this should result in an immediate one game suspension.
Just to be on the safe side, FSU should really sit their first 11

There is a huge difference between 5-9 to 5-11, and 6-4, this should not have even come out as a report of any kind, unless he was specifically reported as the attacker, which the story does not state.
physical descriptions is the number 1 reason som cases are hard to prosecute due to stress and truama, plus I thought I read he was interviewed a week after. The state of Florida is known to not prosecute star athletes

This smells like something an SEC, PAC12 or Ohio State blogger would drop at the "opportune time" to stir the pot. Obviously the evidence isn't a slam dunk or this would have been out there a long time ago.

or she couldn't be bought off, urban was famous for this at the other school

Yeah but, Ohio State suspended Carlos Hyde three games for allegedly striking a woman at a club before the season start and no charges were ever filed in that case.

He definitely assaulted that girl. We don't need complete evidence. Guilty.

Signed,
Mark Schwarz

If he is guilty, he should be punished. If he isn't, he should be free and cleared. It's that simple to me.

Not to sidetrack the conversation, but can you really NOT write s e x ual in a post?

Because the board is full of young, impressionable minds and if people see the word sex written out they will think it's OK to go the Antonio Cromartie route of fatherhood.

Suspend him and loan Charlie Loeb to FSU for the game. The FSU cheerleaders will all swoon and faint on national TV. Awesomeness.

The conclusion given the little amount of actual information out there seems to be that there was a complaint. Winston's name came up somehow as part of it. The police contacted his attorney, and cleared him without needing to interview him. The fact that the description doesn't match by a long shot may be a part of that, or Winston may have a credible alibi. His lawyer says he's provided affidavits that show Winston wasn't involved.

The investigation is "ongoing" because a complaint was made, and nobody has ever been arrested. Just because Jameis is cleared doesn't mean they close the case, unless the police are prepared to declare that no crime took place at all and call the girl a liar. Which they wouldn't and shouldn't do. But just because the investigation is ongoing, it doesn't mean the investigation into Winston is ongoing. But apparently somebody got a hold of it and decided to leak it. While the temptation is to blame Alabama or the SEC or whatever, the fact that it went to TMZ means it was probably somebody just making some money. And as far as I can tell, TMZ didn't report anything that wasn't true, only that he came up in the investigation.

The reason it was turned over to the AG now is not because there was some change in the case (unless there's more that we don't know), it's being reported it was turned over because of the media inquiries stemming from TMZ getting ahold of it.

I hope that's the scenario. There are a lot of things that to me fly in the face of this being a guilt and cover-up situation, but I suppose I could always be surprised.

First, at the time this happened, Jameis Winston was just a big time recruit, certainly not a star, and not even the presumed starter. It's not like there would be incredible pressure on the police to cover it up.

Second, while in general athletes get away with a lot, Tallahassee law enforcement doesn't really have a rep of taking it easy on athletes like they do in Gainesville. They generally arrest and prosecute. Years ago Travis Johnson was put on trial on a pretty dubious rape charge, and acquitted in 30 minutes by an all-female jury. Obviously you know they prosecuted Peter Warrick in the midst of a Heisman season and national title chase, and that was for basically having a shoplifting "hookup." We just had a player arrested and charged with sexual assault this summer. I'm not saying nothing has ever been covered up for an athlete, but Tallahassee law enforcement is generally not considered to play that game.

Also, I would be VERY surprised that Jimbo Fisher would roll the dice with this if it wasn't 100%, totally not an issue. Not because he's of some great moral character necessarily (although he has been pretty intolerant of offenses so far), but because having this come up as a distraction and a disruption is absolutely the most un-process, un-Saban scenario imaginable. If there was any fire here at all, and Jimbo took a chance anyway, it would be opposite of everything we think we know about him. That's certainly possible, but seems unlikely.

I have to think if Jimbo had even a nagging doubt of this disrupting the season, he goes with Coker, a guy that most certainly could have won 10+ games this year for us. It's not as if FSU was expected to play for a national title this year, they weren't even the ACC favorite. He wasn't coaching for his job or anything. I just don't see this like a Chizik/Auburn situation where they're going to roll the dice and take their chances it all works out because it will be worth it. That is not they way Jimbo has presented himself at least.

Who knows, maybe that's wrong and this is a legit crime that was covered up. I would certainly be disappointed.

seriously, why did the police try to conceal his identity? I thought florida was a state that was very liberal in their official police reports on releasing information. where they waiting on her to accept a monetary settlement?

the police could have came out and directly said he was innocent of all charges, but to kick it up to the next level makes you pause a little bit.

Hey. No one here really wants this to be true. This guy is a serious ball player and deserves it all. The Heisman, the great pro career. We just want it to be enough of a distraction that we may actually have a 20% chance on Saturday instead of a 10% chance!! Never should anyone either get away with something because they are a big time name and never should it be easy to accuse someone just because they are a big time name.

I hope he doesn't get suspended for our game. If, by some miracle, SU won on Saturday - and he was suspended - the win would get completely discredited. It would be legendary if SU won straight up and without any excuses.

By the way, it sucked this morning. I turn on our local NBC affiliate. They are talking about the Winston scandal. The two dim bulbs were laughing about the 60+ point win FSU was about to enjoy against Syracuse, snicker, chortle, chortle. I suffer from reverse West Coast bias out here.

Way to go out on a limb there. ;)

I know it is simple and I don't think listening to the press or whatever is the route to go. I know you're just teasing but people always seem to develop an opinion without facts and it drives me crazy.

The police can't declare him innocent. All they can do is decide if there is enough evidence to turn over to prosecution. Two scenarios as I see it...

1) There wasn't enough evidence for 11 months but now there is. Most likely this would be a scenario where the victim wasn't cooperating, and all of a sudden she decided to cooperate. This is possible and would be very troubling.

2) There wasn't enough evidence and isn't enough evidence, and the police don't consider him a suspect at all. But once the media gets a hold of the report, they have to turn it over to the AG to sign off that there's nothing there. This is what's being implied by most of what I read, but it hasn't been explicitly stated as such.

The question is really whether this investigation became active causing it to be a media story, or whether the fact that it became a media story made it "active", in the sense that it had to be kicked to the AG for closure. If the police thought there was nothing on Jameis, and possibly even no crime, they were probably going to just let it go cold, but they can't now.

I get what your saying, but I don't get the covering up of his identity, even after the press is on to the story
