I understand its 5 years which is absurd because it usually takes a victim a few years to get the courage to come out and talk about it but my question is, if the tape is real and bernie is guilty, shouldnt he at the very least need to register as a " Sex offender" and to make sure he dosent work or be around kids?

And another question is, if they cant charge barney with anything, why are they searching his house and getting the secret service involved? To see if they can find anything recent maybe?
 
I don't have an answer for you, but I hope the statue of limitation isn't going to be placed on the quad. I'd like to see a statue of Jim Brown first.
 
The statute of limitations is 5 years for NYS ... but that becomes moot with the Adam Walsh law ... signed in 2006 that establishes no SOL for child abuse. Therefore the state/local authorities could turn a case over to the feds if the time exceeds the State SOL. The Walsh Law also establishes the registry (federal) and requirement for reporting depending on the level (there are 3) of child abuse.

The question is, relative to Bernie, is the Walsh Law retroactive from its passage in 2006? Otherwise there may be other jurisdictional involvement such as Pittsburgh. Their police are investigating the allegation of the 3rd alledged victim regarding the alledged abuse occurring in Pittsburgh b/c that iis not beyond the Pennsylvania SOL.

The Feds may be involved also because their exist allegations of transporting a child across state lines for the purpose of... as well as solicitation over the internet/mail, etc.
 
exactly stan, that is the reason for the feds. It would be an outrage if bernie is allowed to go on without at least having to register as a sex offender. if he is proven guilty of course.

Yea I mean they cant just let this predator keep being around kids. So your telling me the local police cant really do anything but he could still face fed time(jail time)?

Seriously, though, the fact that there is (or was...has it changed?) statute of limitations on sexual abuse is utterly absurd. If there is proof the offense took place, I just do not see why the abuser is free and clear to continue preying on others simply because the offenses were not reported within a certain time frame.

At the end of the day, we can probably agree that there are certain crimes for which there should be no statute of limitations.

For all practical purposes there is no SOL for child abuse...
 
After PSU and now this, I'm willing to bet there will be imminent state-level legislation, across the country, to eradicate any remaining SOLs in child sex abuse cases.

That only applies to cases in which there is federal jurisdiction. A purely intrastate case is still within the purview of the general Police power of the states, and local statutes of limitation would still apply.

The federal claim arises in this case since Fine allegedly took Tomaselli across state lines to commit his crime. If Fine had abused Tomaselli solely in NYS in 2002, I don't think there would have been a search warrant.
