Question for other lawyers:

Kid (or actually his parents) sign LOI when he is 17. Why is it enforceable against him after he becomes an adult? Is this true of any other contract?
 
Look at it in reverse. He doesn't have to honor it and can go anyplace he wants. But the NCAA won't let another NCAA school give him an athletic scholie.

you dont have to sign one.. but then the school doesn't have to accept you either..
 
I realize that an underage person would need a parent to sign but I was wondering how it can be binding against him after he turned 18. This was asked to me by my 11 year old.

Bees, if all schools are bound to honor it by the NCAA, and it is not something the courts consider as not binding upon the player because he wasn't an adult when his parents signed, than it would seem ripe for a court challenge.

Given that this hasn't been successfully challenged to my knowledge, suggests I am missing something.
 
You get around the contract issue, by creating rules that prevent other schools from allowing the player to simply walk way from the signed LOI. Player signs an LOI at University A. He can't be made to attend or play at University A, but the NCAA makes a rule that says no other member institution can offer him an athletic scholarship. He can still attend any other University he wants and pay to go or he can go to a non-NCAA school and play basketball right away.
