in summary...

Schwartz and ESPN knew of this tape in 2002 and, thus, knew that Fine had molested Davis and likely others. So, at a minimum, they've known for 9 years that Fine was potentially molesting children.

JB, as we understand it, did not know of the tape and did not know or suspect that Fine had enaged in inappropriate conduct...and in fact knew that such allegations had been investigated and found without credible support.

But Schwartz and ESPN are lauded and JB is in jeopardy of seeing his hall of fame career come crashing down.

Am I missing something?

Color me confused.
 
PS had the tape too.

I do not understand why ESPN and PS didn't run with the story given that they had the tape back in 2002/2003.

I'm somewhat leery of hammering BF at this point as well. I think all the tape really actually proves is that there was some weird stuff going on in the Fine household. If the university wants to cut ties, I think they have reason to do so. I also tend to think, in general, if there is a lot of smoke there is likely some fire.

But ultimately if this case went to court with what we know there would be a boatload of reasonable doubt, right? I mean, your best piece of evidence is a tape that is extremely vague and ambiguous and is made by two people who apparently were lovers with an apparent motive of jealousy on LF's part.

I'm not saying BF is innocent but there are extreme credibility concerns.
 
Dumb question...is there no ethical responsibility of these media outlets to provide this tape to law enforcement at the time?

If the University had this and didnt turn it over to police, they would be getting broiled. But the media has it and does nothing with it??? And thats OK?
 
Freak, I'm with you 100%. The days of the media taking responsibility for their actions seems to be long gone. They have morphed more into the entertainment industry than media/ news.

We part ways there. You should read the transcript. It proves a lot more than that imo. If the feds bring criminal charges, you can be certain they have the goods, and this tape will be a mere footnote (not by any stretch their best piece of evidence). The % of federal indictments that result in guilty pleas or verdicts is stunningly high (I want to say 98% but cannot recall). In any event, the point is feds do not mess around. If a 7 hour search with boatloads of evidence removed does not result in Fine being indicted and convicted of something it would be very surprising.

I'm not saying I know anything of the full investigation. I'm saying, of what we've heard, the most concrete piece of evidence is the tape. Yet the tape talks about an incident when the guy was 27 and had "borrowed" money for a bogus reason. It's also made by a guy who had an affair with the woman on the other end and a woman who clearly resents her husband for some reason, potentially his sexuality. My only point is that if I'm a defense attorney I'm saying there are plenty of reasons to doubt the veracity of that tape.

As a fan, I'm saying I tend to think there was some serious stuff going on here, but in the court you're going to have to do much better than what we've seen.

I don't think SU cut ties with Bernie solely based on the tape. Remember there was a 3rd accuser who has come forward as well. SU may have also gotten some back channel information regarding the results of the search warrant that was executed that could also have provided additional reason for the firing.
