The one thing everyone is forgetting, is unless this is a slam-dunk conviction Florida can't afford another high profile trial. After the last 2 trials with Anthony, then the last with George Zimmerman, the state looks like a horse's a**. The rest of the country wouldn't believe a conviction, because of the recent past incompetence. So regardless of who the person is who has accused him, and whoever they might happen to know, after the George Zimmerman trial the state can't afford any more embarrassment. Its much easier to say that under the current law, the facts don't warrant going to trial.
I don' t think that you announce you are charging someone. Winston would have been invited to surrender to authorities for booking and then a PC would have been held.they had almost a full year to clear him....actions by Tallahassee P.D. smells of a cover-up.
Winston's lawyer first said he was not involved, then bam!!!! then comes the DNA evidence and his lawyer follows up with that we knew all along as he said it was consensual s ex. Then why didn't he offer that up in the first place.
Meggs did say he needed to interview one more person at the end of last week...Winston? And if Winston refused like most lawyers who say he should, then why wait to charge him.

Sure. However, the statute of limitations might have run. In NY, its a year for an intentional tort.Is there such a thing as a civil case for this type of accusation?

My guess at Meggs statement: "There are only 2 people who know the truth. We do believe the victim in this matter. However, we do not have any phyisical evidence to corrobarate either parties' story. Without that, I cannot, as a prosecuter, go forward with a good faith belief that I have the ability to obtain a conviction. Therefore, this office will not be filing charges agains Mr. Winston."
