The courts are really hammering the NCAA, after years of Draconion and arbitrary rules. To be salvaged, there must be Federal legislation, some sort of antitrust relief, and Congress must expressly pre-empt state laws on all matters the legislation covers. College athletics clearly comes under the interstate commerce clause, so it is ripe for federal guidance.
(It also appears the NFL/Goodell is getting its comeuppance with some recent court rulings that the arbitration clause giving the commissioner sole authority is unconscionable and unenforceable. The most recent one I saw was Neveda, in the Gruden case.)
