...although I have brought parts of this up in other threads, I thought it may be a good idea to reiterate what is transpiring in this case and why Bernie could/could not be on the hook.
Obviously, we all believe he is innocent. But here are factors that may have a significant impact on the case:
1. Initially and in the three times the case has previously been looked at by police, University, ESPN, Post Standard etc there was no collaboration about events and abuse. ..so the accusations were considered not real. However with Lang stepping up to the plate and indicating he too was abused...new light is shed on the accusations.
2. This does not mean the accusations are true; it means a game changer may have come up. Most authorities on abuse, believe that the abused tries to have a short memory about what took place...they go to an extreme to deny...but over time they may come to grips with it and want to talk about it and claim they were abused
--unfortunately, Lang coming forward fits this mold in theory and therefore calls into question the fact that there was no collaboration previously and that is one of the primary reasons the case was not taken to its next step...prosecution.
--also a reason why Cantor had no choice but to place Bernie on administrative leave
3. There was little information released from any of the investigations and in fact the University investigation, which could not find collaboration went no where...there was no news no outcry...couple this with the fact that the SOL ran out...it goes to age 18 plus 5 years in NYS may be reason why Bernie never went to a civil suit to claim defamation of character...and why the accusations were dropped--let lying dogs lay
4. NYS is out of play probably for both a legal and civil remedy...as stated SOL has expired...however, it has been mentioned that in 2003 in NC that Davis was with Bernie. If that is in fact true, and he was molested or not, Louisanna could investigate...its SOL is age 18 and 30 years...ugh. So it is possible that Davis and/or Lang have a case if something happened in Louisianna.
5. It appears that OTL did rush the story as it didnt want to be scooped (no pun here to our PG).
--although even Mike Waters indicated that if collaboration was present...Lang backing up Davis' story, the Post Standard would have run the story...so ESPN is doing just that...running the story because of the GAME CHANGER...Lang's coming forward.
The outcome here is not necessarily black and white. We are all hopeful Bernie is innocent...and we are hopeful there are no abused children that are now adults. My bet is that this case may well go on for months depending on whether other states are involved; whether Lang and Davis are to be believed; and whether any other person comes through with either information concerning Davis/Lang and/or any other person abused.
