This will probably get thrown out after a painfully long, lazy process then the University will go right back to taking profits off his and the team’s likeness
Yep, I hope his attorney has already threatened them with a massive civil suit because if there is one thing SU protects it’s their profits, and that could scare the hell out of them
 
If this doesn't get handled quickly by the local authorities and the school, and it gets to litigation, that can be a tough one due to SU's private status. FIRE (who I mentioned previously) has a good history defending against the abuses of "kangaroo court" situations like these, but it's trickier for privates. Have to find some violation of the school's own stated policies kind of thing. Unless there is a legitimate due process concern. Not enough of an expert to say.
Inconsistent degree and severity of punishment for similar transgressions by other students. Have to imagine this is not the first case.
 
He was defending himself and wasn’t charged. Complete malarkey. If these are indeed the facts and are undisputed. I think I would like to see Dino come out publicly in support of him.
He absolutely should. Maybe he thinks that would make the situation worse for Allen. Oh look, the forward coach is protecting his star running back sort of thing.

On a first time offense... no way.

Unless the board has changed their ways.. this is not how these kind of fights have been handled consistently in the past.

This is where Allen might have civil suit case and this gets tossed. If the Kangaroo court doesn't hand out full year suspensions for every single fight then they have a problem. If Allen's punishment is in line with every fight punishment dished out then he might be stuck.
 
I can not for the life of me think of any judiciary based organization denying basic constitutional and due process self defense rights from any defendant and getting away with it. 2nd Amendment allows the right to 'bear arms' or 'use weapons' 'a punch' in defense of his well being and liberty. While not literally mentioned I think it can also be argued along with denial of the basic human right or the right to a defense of self defense. If a women was punched twice and then responded the way he did can you imagine the women not being allowed to mention self defense or the context of the use of force thus getting suspended?! This is the very definition of arbitrary and capricious.. when the case was 'decided without reasonable grounds or adequate consideration of the circumstances.' Being denied context is the very basis of being denied basic rights and true justice. He has alot of strong legal arguments to make and just by saying that SU is a private entity is denying that even private organizations have to follow the law and establish rulings based on sound legal standards.

Can a scholarship and NIL be subject to due process requirements?
