Why did the school's attorney know of this tape?

They did a 4 month investigation and Davis never told them of this tape??? Seems very strange since at that time in 2003 the tape was current.

It seems that JB and the University relied heavily on this investigation. I wish that report were made public. Oh, it probably will.

I question whether SU knew about the tape. Word would have trickled down to JB and eventually Bernie. Wouldn't Bernie have then divorced his wife if he was innocent? Even if he is gay, it was 2005 and more acceptable by then. Heck NJ had a governor outed the year before. He may have had to retire as a result but he was already in his 60s. I rather take that action then live with a woman who tried to get me put in jail. Then again if he is guilty it explains him staying with her. In which case SU should have forced him to retire based on that action.

The PS says Davis "gave" ESPN the tape in 2003. Was that the only copy? I can't imagine he wouldn't have copied it, but who knows. Maybe he just didn't mention it cuz ESPN had it. No idea.
