It is a bit exhausting I would agree.Granted I don't follow other schools as closely as I do SU, but it does seem like something every year at SU. It's pretty exhausting.

He is claiming that at the first two levels of the SU judicial system, (before one student and then before the student board) he was told that self defense could not be raised or considered. Even if he is right there, the final SU appeal before the adults did discuss self defense and rejected it. One may disagree with their conclusion but there is a big legal difference with addressing a defense and rejecting it and never addressing an available defense in the first place. Only the latter is usually able to be successfully legally challenged.
LaQuint's argument is that if the first two levels considered self defense, they may have not given him a two semester suspension. A court will generally not make that type of assumption, especially if the last level of internal appeal did uphold the suspension and did address self defense. Even so, a one semester fall 2023 suspension would take him off the football team this season.

I once had a Chinese student with very limited English skills ask me once to represent her in an expulsion proceeding.
She was accused of violating student code because she wouldn't disclose a patentable idea that she was working on for an engineering class, to allow other students to work on it with her. Of course, this would have risked her patent, or allowed others to share in it, which she didn't want.
They would not even allow me in the room when the hearing took place, and she was kicked out of school.
The Chancellor is the ultimate day to day authority on campus. To suggest that he and the University have to be held to whatever inane decision comes out of the disciplinary process is silly. I do agree that there are probably lots of messed up decisions involving non-athletes, as a parent forking over $70k plus to send my kid to SU I’d be apoplectic about that too and be in court.Maybe he did ask the dean and the dean just said no. Maybe the chancellor doesn’t have control in matters like this. How would it look if the chancellor did act on a players behalf, undermining the punishment process set in place by faculty, administrators and students?
A lot more messed up rulings happen on campuses each day that don’t come to light because the student isn’t an athlete.

He is also arguing in effect that the punishment does not fit the crime. SU suspended him for a year with the opportunity to be reinstated again to finish his degree after a year and presumably play football again. I doubt a court will consider that as a result that "shocks the senses". We may disagree but a court usually is very careful not to interject itself into discretionary decisions that were made at lower levels unless there is a huge miscarriage of justice. I would suspect that SU can show that they have suspended many students in the past who got into a fight with another student so as to show that LaQunit is not unique.
