Kyle McCord to NFL Draft

Based on a combination of talking with people very close to the program, fact checking, and reading in between the lines. Here is what I believe. The waiver was requested a while ago as many have mentioned. It was originally declined. They have submitted an appeal- an appeal in which Ryan Day has in fact signed off on for wrongfully blowing his redshirt in garbage time. That has the potential to cost Kyle significant financial loss. In today’s day and age, the NCAA is under such scrutiny they have become much more favorable in granting appeals.
Now, the one year anniversary of Kyle’s commitment is tomorrow, Dec 17th. There has been much talk that the school was hoping for an answer on the appeal sometime this week. Let me ask this, why is the “CLUB DART” NIL party being held during the middle of the week? Where better to make such an announcement?
As we seen today with Brady Norton, schools try to land commitments while the kids are in visit during portal season. It prevents them from going on to the next opportunity. Rickie Collins was a sho in to accept on his visit but the staff didn’t offer.
There’s a reason why the staff is slow playing and not offering. I am going to go out on a limb and suggest my opinion- “Cuse knows or will know tomorrow or Wednesday morning”. Kyle will get his extra year, and a public announcement will be made Wednesday Night. I could certainly bring completely wrong, or slightly wrong- but I firmly believe that my theory holds strong possibility!
This is a very convincing theory. The club DART party is tomorrow night (Wednesday) and the cover photo is just Fran and Kyle

A lawsuit for financial damages does nothing for eligibility.

NIL was around during his FR year.

He cannot bring a lawsuit for denial of eligibility until he is actually denied eligibility which seems to have not happened yet. Then he needs to decide if it is worth it. He may not.

If he does he has to hire lawyers out of his own pocket seeking one of two resolutions…

He can say that he was the #1 passer and the going rate is $3M

1. A settlement where the NCAA pays his legal fees and grants him another year. This needs to be settled before the draft deadline. If it does not then he will declare for the draft and not settle.

2. He goes all in for the $3M and declares for the draft.

Both are good outcomes for Kyle. The only good outcome for SU is #1 within the next 3-4 weeks. Which is a very small window.

I still think to avoid any messes that the NCAA does 5 for 5 which they are already looking to do. That might explain the delay.
My point is that the NCAA will seek to remedy this now because they know McCord has decent footing for a lawsuit and they don’t want to deal with it. And hopefully that means 5 for 5 like you said because that’s the right thing to do in this era. The 4 game thing is so arbitrary anyway.
 
Question for the legal minds. Does the pending settlement that provides back pay for players going back multiple years make the appeal stronger?

I think that would be a tough one to win for McCord and I doubt the NCAA is concerned about the lawsuit, IMO

the club dart event is not tied to a kyle announcement for what it's worth. that was planned right at the end of the season and kyle's status is still up in the air. it would be an amazing timing coincidence if it worked out that way though.
 
if the decision goes in syracuse's favor (lol, yeah right) it will be IMO because they're approving the 5 for 5. Otherwise, unless there's some evidence to truly support this waiver approval outside of NIL damages (maybe thats enough) this opens pandoras box.

Unless of course you factor in "30%" with the expanded playoff could be 17 games (5.1 games)

Yes Kyle's year(s) in question the playoff wasn't 12 games, but moving forward it is. So a kid on Clemson (10-3) who played in say 5 games -- if they make it to the national championship game (game 17 for them) how is 4 games fair, and not 5?

That may be very true. And the timing is extremely coincidental. The facts remain the same. The waiver request was submitted and denied, the appeal was signed off by Ryan Day, the appeal has been submitted. Those are all undeniable facts.

The NCAA decision is expected and it could be today and it could be next month. The questions that everyone should be asking is, does Kyle Mccord have legal representation (only to keep the NCAA honest and to expedite), is the school issuing a dual request, and most importantly, does the NCAA want to be part of a decision or lack there off that could have a domino effect and quite possibly be dragged through the mud?

It is in best interest for all parties involved to have a decision much sooner rather than later. With that said, and here is where reading between the lines comes into play, if Fran Brown had a greater doubt than optimism it seems like he would approach the transfer portal much differently. Kyle is going to get a much larger NIL package if / when he comes back. Money that could be spent on other players. And if they didn't either know something or have reason to believe, I think it'd be fair to say they would have already locked up another QB for 25.

All signs point to Mccord in 25. So let me ask you- even though the CLUB DART party was planned well before. What better place to announce? The main reason is to increase NIL funds, I think that announcement would create a massive donation.

If they wanted to raise more money, they'd announce it before to increase demand for the event. It's not sold out yet. They want more to attend.

You don't think that the people who are in attendance will be more inclined to make a larger donation after the announcment? Combined with the post event donations when they NIL use the announcment as news on social media?
