.08 is typically “let’s get you a ride.” My guess is if he did a roadside test, he was higher. There is time in between when someone is arrested and they blow at the station. There is a 20 minute observation period, before someone is even allowed to give a sample on an instrument so BACs can go up or down from the roadside depending on when they had their last drink/drinks. It gets tricky with anyone under 21 because of zero tolerance laws. There is no aiding and abetting DWI law in NY for DWI.

If the cops suspected they switched driver/passenger after pulling them over, but couldn't prove it, they could arrest them both for drunk driving (or accessory) just to make life harder on then.

Dealing with a criminal matter is a big hassle even if the charges get dismissed quickly.

Or maybe they just do that if both are underage.
 
This happened like 15 minutes from my house, they were in the middle of nowhere... Very odd place for two college kids to be going through at that hour, or ever... Party out in the woods maybe?
 
If he was sober and let someone who was drinking drive his car he was wrong or if they were both drinking and he let someone drive his or their own car he was wrong.

Not saying they kid deserves jail time but I’m not sure how it can be twisted into him being a victim haha

Seems like some murky stuff. You have to encourage the person in some way .. verbal or non verbal .. him merely driving your car isn’t enough .. a decent lawyer gets him out of this

Giving him the keys was the non verbal aiding.
 
It’s not silly when it’s the passengers car and he gave the driver the keys.
Maybe he was too gone to drive and thought the other kid was ok t drive. Not saying it's smart but he shouldn't be charged with a DUI.
