Rex at it again

Rex is a player's guy. He once used a Jets draft pick on Sanchez's best friend because he made a promise to his QB, despite the fact that players were on the board who the staff wanted. He's loyal to his guys and he'll certainly keep things interesting in Buffalo.

I finally saw the interview with him on HBO last night -- he got really emotional when having to talk about leaving his players on the Jets, he needed a few moments to compose himself a walk away. He might be an ass, but he loves his guys.

I'm wondering something similar. If Brady did no wrong, why would he agree to miss even a game...that's really odd to me. Especially for an uber-competitor who is clearly concerned about his legacy.

Makes me wonder...
First off the Schefter source was clearly countered by Albert Breer.
Albert Breer @AlbertBreer
Per source, no material terms were offered during Tuesday's settlement talks on Brady. Parties still stuck on facts (re: guilt) of the case.

Tom Brady is open to accepting some form of suspension, but only if it can be for failing to cooperate with the NFL…
Posted by Adam Schefter on Wednesday, August 19, 2015

Brady's side is showing the judge they are listening. The NFL is been stubborn demanding the NFLPA/Brady accept the Wells Report. If the NFL wanted a game they would take this "deal" in a heartbeat. Why would the NFL not take the deal?

Per 2 sources informed of Tom Brady’s thinking, his stance hasn’t changed. Not willing to accept any suspension in settlement at this point

POS of NFL have leaked more false info on this case. Brady is more likely to get 4 games than settle for 1 or 2 let people say he caved.

So much arrogance and ego on display from all sides. Truth is that most think Brady cheated and that Godell is a goon. Nothing will change from this perception wise at all.

Only reason I can think is that the NFL wants to protect the Wells Report, for whatever reason. It's clear the NFLPA knows they look like idiots for giving the commish the power to hear an appeal, which means all those guys will be booted out of cushy jobs by the players.

It all seems to be a battle of arrogance from the beginning.

By the way, all the NE fans talking about how cold weather makes the ball deflate need to remember at kickoff the temp was in the 50s. I was 15 minutes from Foxboro that day. It wasn't cold at all.

3 of the 4 Indy Balls were below 12.5 how did that happen?
Ideal gas law dictated the Pats balls were in the range. The NFL has no evidence and suspended a player 25% of the season without anything. When the team took the penalty of losing a 1st round pick with the idea of giving the NFL their pound of flesh and leaving Brady alone.

The NFL should have been happy nailing the team. They can't get Brady without more and they don't have it.

this whole thing is nonsense.

he broke a league rule, then lied to cover it up.

punish his arse.

people get fired daily in the workplace for lesser offenses than just lying or failing to cooperate with comliance.

screw him, hes getting what he deserves.

which apparently is more time on the beach with the kids, and in bed with giselle ,so what the is he complaining about??

Please tell me the rule Tom Brady broke and how he did it? The NFL was asked this question by Judge Berman and told him basically whatever he did doesn't matter because Goodell can do whatever he wants based on CBA.

Don't forget the Wells Report relates to the AFC Championship game. Wells found nothing in relation to that game. The Judge has hammered the NFL. Brady's side has already given the Judge way more than the NFL.
The NFL wants Brady to accept the the Wells Report when the Judge wouldn't. They are starting this whole proceeding with a non-negotiable demand.

i dont think he screwed up rice. ...we all know what he did, didnt need to see a video to decide the degree of badness. it was a moment of weakness, 1 in which he seems truely apologetic and depressed about...and now his ability to play football and make a living is ruined. i feel for him.

i dont have a problem with peterson either.

as for brady that cheating sonofabitch...

.... my hate for brady will be intensified a trillion times as he will have done his best to ruin the great game of football.

You are truly one misguided dude.

You are truly one misguided dude.
so you think peterson shouldve got more than a year??

ok, im cool with that.

the rest i stand behind.

If the NFLPA and Brady are so confident why are they willing to deal and take a reduced suspension? Wait for the verdict and face no suspension! Be careful to what you read and the "spin" being put on it

Why?

Because taking all or nothing risks are generally stupid if you can buy down a reasonable outcome with certainty.

Which is true.

Actually no you can't. The arbritrator has to be evident inpartial . Roger Goodell was the direct opposite by being evident partial. Goodell was overturned in the federal court in the Rice case because he was an interested party. In this case he again was an interested party because he dished out the penalties. Goodell should have had someone else be the arbitrator even though the CBA gave him the right he didn't have to do it. This judge can rule the arbritrator was evident partial and thus vacate the award.
However this judge wants. Settlement so neither side can appeal. Judges hate one thing more anything which is being overturned on appeal. Berman wants the NFL to get off the Wells Report being accepted that is why he is hammering the NFL. Brady's side has played ball.

This judge could rule whatever way he wants but he risks it being overturned on appeal that is why he wants a deal.

Thought he dished out penalties before the arbitration?

If the players don't like the commish having that much power, they need to renegotiate the collective bargaining agreement.

It really doesn't matter to me. I'm not taking a side. I think they are both being egomaniacs.

The Federal Arbitration Act which is binding law in the 2nd Circuit establishes three grounds for vacatur(legalese for vacating) for an arbitration award. The Judge put the NFL lawyers on notice for each of these to get them to settle. In laymen’s terms, they are:

1) Evident partiality (I explained this above e.g., ruling on the law of shop application of cases where the arbitrator was the losing party, like Goodell did with Rice and Peterson)
2) Arbitrator misconduct (e.g., refusing to hear evidence or testimony material to the controversy, as Goodell did with Pash’s role as co-lead investigator *and* refusing to hear the improper delegation argument prior to the proceedings) Judge Berman HAMMERED the NFL lawyer for not making Pash available and said this alone could allow him to vacate the award.
3) Failure to draw essence from the applicable contract (e.g., making a determination on contract language that no reasonable person would have made)

NFLPA and Brady have very strong arguments on points 1 and 2. Their only weakness on point 1 is that the CBA’s Article 46 kind-of-sort-of allows for a partial arbitrator by allowing Goodell to serve at his discretion. Regardless of whether or not he is allowed to be partial, though, he *MUST* conduct a fair and consistent hearing. However, Goodell was NOT FAIR by not allowing Pash to testify and allowing Ted Wells to use attorney-cilent privilege in answering some questions. Anybody who read the transcripts know this hearing was a kangaroo court and was not conducted fairly. I mean the NFL put a time limit on evidence that is a joke.

If Berman rules for Brady on points 1 and 2, it will be very hard for an appeals court to overturn the decision, as the evidence is plainly available and very direct. That is why I believe Berman is telling the NFL to settle rather than foce his hand.

Like I said - egomaniacs. They both took it do far that no one wins or loses. They both lost.

Anybody who is objective realizes the NFL had nothing on Brady. The judge has embarrassed the NFL attorney on this point. The NFL should have been happy taking the 1st round draft pick and 1 million dollar fine. However they want to the ability to punish players now without evidence when that is a joke. The appeal hearing was such a joke. If you read you see how dumb honestly Roger Goodell is. The guy has no clue about the law and had to have his personal lawyer halfway during the hearing make evidentary rulings on objections because he didn't know.
This who ordeal has showed the NFLPA has terrible leadership and got killed in the last CBA. The fact Goodell has taken this case this far with nothing is a joke.

If people take off their hatred of Brady/Patriots binders and look at the case its a joke. Believing they cheated is fine but if you can't prove it you can't punish. The fact Kraft took the penalties with a quid pro quo agreement with Goodell and then Roger listening to Biscotti, Woody Johnson, Jim Irsay saying get every pound of flesh is a joke.

Goodell tomorrow under the CBA could pretty much suspend a player for believing they did something and not being able to prove it if this stands.

Look, I don't have a NFL rooting interest and I think this whole thing is nonsense, but when I hear NE fans (not saying you) pointing to cold weather as the reason why the balls were under the 12.5 and that's all I'm saying is nonsense. It dropped into the mid 40s during the 1st half. I don't need a gas law to know that cold weather didn't make the balls deflate mid-game.

I do believe the NFL is making stuff up as they go and didn't really care about the psi until they got complaints from Baltimore and Indy. I think Brady made this worse by his BS from the start and that made things look worse. I don't think NE gave up a 1st rd pick to protect Brady because Belichick doesn't treat 1st rd picks like Doug Whaley. I'm not a Pats hater, but I think they gave in to the NFL early on because of some other reason.

The only comment I make on this stupidity... A real commissioner would have squashed/settled/buried this thing within 6 hours of it becoming public. It's a joke and makes everyone look moronic.

Adam Silver basically took Donald Sterling's franchise away within 3 days of his racist comments blowing up. Meanwhile we're in month EIGHT of possibly-one-point-five-PSI-lower-than-it's-kinda-supposed-to-be-Gate.

I'm a Bills fan who should be interested in the outcome because of week 2 - and even I'm sick of it and just want it to end.

From side of box used to sell official Super Bowl 49 footballs: manufacturer implies “air retention” could be issue.

So while people before this crap had never heard of the Ideal Gas Law. Balls deflate when used and also the Pats had the ball over 19 minutes in the first half of the AFC title game. Including 11 minutes in the 2nd quarter. If you read the Wells Report and appeal hearing you see the science backs up the Ideal Gas Law of where the football should have been.

If the NFL could prove the Pats cheated this case would be shut. The NFL can't prove anything even was done to the balls.
